What is the O-1 visa?

The O-1 recognizes individuals with extraordinary ability or achievement. The O-1A covers sciences, education, business, and athletics; the O-1B covers the arts and the motion picture/television industry. There's no annual cap or lottery, no degree requirement, and no minimum salary — which makes it a common fit for founders, researchers, and early-stage companies as well as established professionals.

Key benefits

  • No cap or lottery — file at any time.
  • Unlimited status extensions.
  • No degree requirement, and no minimum salary threshold.
  • Premium processing available (typically 15 business days for an additional government fee).
  • You can hold O-1 status with multiple employers concurrently.

Building your case

You qualify either by a major, internationally recognized award, or by meeting at least 3 of 8 criteria: nationally/internationally recognized awards (including significant venture funding or selective accelerator participation), critical employment in a distinguished organization, press coverage, judging others' work, membership in selective associations, high remuneration relative to your field, authorship of scholarly articles, or original contributions of major significance. Evidence for one criterion can often support another.

Common challenges

  • Framing a career narrative that clearly maps to the O-1 criteria rather than a general resume.
  • Assembling the right mix of letters, press, and documentation — quality and specificity matter more than volume.
  • For founders, showing the startup itself is credible, significant evidence of your standing in the field.

Process and timeline

We start with an O-1 assessment to determine likely eligibility, or to identify what to build up before filing. From there we assemble the evidentiary record and file the petition, with premium processing available if timing is tight.
